Fourth Session of the Legal Mini-Class: Know the Law, Understand the Law, Use the Law, and Abide by the Law—Guizhou Xianfeng Conducts Legal Training on “Legal Risks and Prevention in Enterprise Employment”

To continuously promote the normalization of a rule-of-law-based business environment, standardize enterprises’ lawful employment practices, enhance their capacity to prevent legal risks, and support their healthy and efficient development, on the afternoon of April 11, 2024, the Audit and Legal Affairs Department of Guiyang Xianfeng held a legal knowledge training session titled “Legal Risks in Enterprise Employment and Risk Prevention” in the small conference room of the Marketing Center on the first floor of the company. Attendees included members of the Audit and Legal Affairs Department, the Party and Mass Work & Human Resources Department, and heads of various departments.

This training session was led by Bao Demei, a staff member of the Audit and Legal Affairs Department. The content of the presentation focused primarily on three key areas: drafting contracts, the probationary period, and risks associated with work and overtime. First, Bao Demei clearly explained the risks faced by enterprises that fail to sign labor contracts with their employees, and proposed corresponding measures to help businesses avoid excessive exposure to double compensation liabilities. Next, she emphasized that paying social insurance contributions for employees is a legal obligation of employers, and such obligations cannot be evaded through signing agreements waiving social insurance contributions or offering compensatory payments instead. Finally, she highlighted the risks and preventive measures related to the probationary period. Using a brief case study, she illustrated risks such as unlawfully terminating an employee during the probationary period, extending the probationary period beyond legal limits, and paying wages below the statutory minimum during the probationary period. She pointed out that the probationary period must comply with both legal requirements and contractual provisions; employers may not arbitrarily extend the probationary period or terminate an employee during this period without cause. Otherwise, the employer will be held liable for corresponding compensation.

After the training concluded, Peng Zhenhai, Head of the Audit and Legal Department at Guiyang Xianfeng, highlighted key considerations regarding overtime approval, focusing on issues identified in the company’s daily operations. He urged all departments to arrange employees’ rest time reasonably, ensuring that work productivity is not compromised. Standardizing employment practices is not only essential for preparing for an IPO but also crucial for the company’s long-term development. Finally, members of the Audit and Legal Department engaged in an in-depth discussion with the attendees, answering one by one several legal gray areas encountered in their day-to-day work, thereby making their operational efforts more targeted and effective.
This training not only enhanced the participants’ awareness of the rule of law and risk prevention but also strengthened the company’s ability to proactively identify and address legal risks and resolve legal disputes. At the same time, it will help better standardize enterprise employment practices and support the company’s lawful and compliant operations.
